We can also help you find other experts like lawyers. Usually a lawyer will prepare individual articles of association and check the availability of your preferred company name. They will also check if you need an official permit for offering your kind of business and find a notary public. If requested, they can prepare employment contracts and make sure the company’s name and trademarks are protected. All this should be arranged before the clients come to Germany. The shareholders finally set up the company in front of a German notary public. The managing director personally opens a bank account on the German company’s name, pays in the nominal share capital and gives evidence of that to the notary public. Therefore and for the next steps he or she should be present at least for a few days. The notary public applies for registration of the new company at the local registration court. The managing director signs an office rental contract If necessary and allowed, authorities grant the official permit to carry out the requested business. Thus, the local registration court enters the new company in the German commercial register. After the managing director has signed the questionnaire, Benefitax submits all requested documents to the authorities. The tax office may want to see the office premises, ask for additional documents or may want to interview the managing director on the business plan.
